Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of sellcondhand.ng, including our website, mobile app, and every service offered through them — the auction and marketplace for used and certified pre-owned electronics, standalone escrow deals (Escrow by Sellcondhand.ng), and doorstep device repairs (Repairs by Sellcondhand) (together, the "Platform"). sellcondhand.ng is operated from Surulere, Lagos, Nigeria, and is built and offered primarily for Nigerian users. By creating an account or otherwise using the Platform, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, please do not use the Platform.
1. Who These Terms Apply To
"You", "Buyer", or "Seller" refers to any registered user of the Platform. The same account may act as both a buyer and a seller. "Engineer" refers to an independent technician approved to accept jobs through Repairs by Sellcondhand — Engineers are independent contractors, not employees or agents of sellcondhand.ng (see Section 13). "We", "us", or "sellcondhand.ng" refers to the operator of the Platform. You must be at least 18 years old and able to form a binding contract under Nigerian law to create an account. sellcondhand.ng is a marketplace operator that facilitates escrow-protected transactions between independent buyers and sellers — we do not manufacture, own, or take title to any device listed on the Platform, and each sale is a transaction between the individual Buyer and Seller.
2. Account Registration and Verification
To use the Platform you must register with an accurate full name, email address, and phone number. You must confirm your email address by one-time passcode (OTP) before you can sign in — phone number verification is not required just to register or sign in. Sellers must additionally complete identity verification (KYC) before their first listing goes live, so that buyers know who they are dealing with, and anyone applying to become an Engineer must complete identity verification before their application is approved (see Section 13). Separately, you must verify your phone number by OTP — reachable any time from your Profile — before you can request a wallet withdrawal or book a repair through Repairs by Sellcondhand, so we can confirm we're dealing with the right person before money moves or an Engineer is sent to an address. You are responsible for keeping your login details confidential and for all activity that happens under your account. Notify us immediately if you believe your account has been accessed without your permission.
3. Listings and Condition Grading
Sellers are solely responsible for the accuracy of every detail attached to a listing — brand, model, specification, photos, and condition grade (Grade A – Excellent, Grade B – Good, Grade C – Fair, or Grade D – Damaged, as defined in our Condition Grade Glossary). Every listing is reviewed by an administrator before it is published, but admin review checks presentation and plausibility — it is not a physical inspection of the device and does not guarantee the listing is accurate. Deliberately misrepresenting a device's condition, specification, or history is a breach of these Terms and may result in the listing being removed and the account being suspended.
4. Auctions and Bidding
A bid you place on a live auction is a binding offer to buy. When you win an auction, you are obligated to complete payment for that device. Bids are placed in fixed increments and may be entered manually or through our proxy (max) bidding system, which automatically raises your bid up to a limit you set. To keep auctions fair, any bid placed in the closing minutes of an auction extends the closing time briefly, giving other bidders a fair chance to respond, until no further bids are placed within that window. You may not bid on your own listing, use a second account to bid on your own listing, or coordinate with another user to manipulate the price of an auction.
5. Marketplace (Buy Now) Purchases
Marketplace listings are sold at a fixed price on a first-come, first-served basis. Completing a Marketplace purchase creates the same binding payment obligation as winning an auction.
6. Standalone Escrow Deals (Escrow by Sellcondhand.ng)
Separately from the auction and Marketplace, you can use Escrow by Sellcondhand.ng to protect a deal you've arranged directly with someone else — for any item or service, not limited to electronics. Whoever creates the deal (the "Initiator") invites the other party by email or phone; the counterparty doesn't need an existing account to accept the invite. Once accepted, the deal follows the same payment-held-in-escrow, delivery-confirmation, and payout mechanics described in Section 9 (Payments, Wallet and Escrow), and the same escrow fee and commission described in Section 10 (Fees and Commission) apply unless we state otherwise when the deal is created. Because a standalone Escrow deal can cover items or services we don't otherwise review or list, sellcondhand.ng has even less visibility into what's being exchanged than on the Marketplace — Section 8's disclaimers about not certifying ownership or condition apply with equal force here, and it is the Initiator's and counterparty's responsibility to agree on and accurately describe what's being exchanged.
7. Missed Payment and Missed Dispatch
Winning an auction or completing a Marketplace purchase creates a real payment obligation, and getting paid creates a real obligation to ship. To keep the Platform fair and reliable for everyone, both are enforced automatically as follows. This section applies to Auction and Marketplace orders — Repairs by Sellcondhand has its own cancellation and completion process (see Section 13).
Buyer non-payment. After winning an auction, you have 48 business hours to complete payment (Monday–Friday only — weekends don't count toward this, so a win on a Friday effectively gets until the following Tuesday). If that passes unpaid, you're not penalized immediately: a further 48 business-hour grace period follows, during which you can still pay with no consequence. Only once the grace period also passes without payment is the order automatically cancelled and the device relisted for other buyers — you keep nothing and owe nothing further, but the missed payment counts as a strike on your account. (Marketplace/Buy Now purchases are paid for at checkout and aren't affected by this — there's nothing to miss.)
Seller non-dispatch. Once a Buyer has paid, the Seller must get the order marked shipped within 3 days. If that window passes without the item being shipped, the Buyer is automatically refunded in full to their sellcondhand.ng wallet, and the Seller forfeits an amount equal to the commission the Platform would have earned on that sale (deducted from the Seller's wallet balance, capped at whatever balance they actually have) as compensation for the Platform's lost commission and the administrative cost of the refund. This is not a penalty in excess of our actual loss — it's intended to reflect it, consistent with how amounts payable for a breach of contract are treated under Nigerian law. The missed dispatch also counts as a strike on the Seller's account.
Strikes and suspension. Buyer non-payment and Seller non-dispatch are tracked separately, each on a rolling 6-month window. Within that window: a 1st strike suspends the relevant privilege (bidding/buying, or listing/selling) for 7 days; a 2nd strike suspends it for 30 days; a 3rd strike suspends the account indefinitely, requiring us to review the account before it can be reinstated. We may also suspend an account outside of this schedule at our discretion for a serious or repeated breach of these Terms.
8. Ownership, Authenticity and Stolen Devices — Please Read Carefully
This section is one of the most important parts of these Terms, because it protects both honest sellers and honest buyers on the Platform.
Seller warranty of ownership. By listing a device for auction or sale, or offering a device as part of a standalone Escrow deal, the Seller (or Initiator) represents and warrants that they are the lawful owner of the device (or are authorized by the lawful owner to sell it), that the device was legitimately acquired, and that it is free of any lien, police report, network blacklist, finance obligation, or third-party claim of ownership. Listing, offering, or selling a stolen, cloned, IMEI-blacklisted, or otherwise unlawfully obtained device is a serious violation of these Terms and, separately, may constitute a criminal offence under Nigerian law, including under the Cybercrimes (Prohibition, Prevention, etc.) Act and applicable provisions of the Criminal Code / Penal Code relating to stolen property and obtaining property by false pretences.
We do not certify that a device is not stolen. Our listing review confirms that a listing looks complete and plausible before it is published — it is not a forensic, police, or manufacturer check of a device's ownership, IMEI/serial history, or blacklist status, and we do not have the ability to independently verify title to every device sold on the Platform. Buyers are strongly encouraged to independently check a device's IMEI or serial number status (for example, through the device manufacturer or a network operator) before completing payment or immediately upon delivery, and to raise a dispute through the Platform before confirming receipt if anything looks wrong.
sellcondhand.ng is not responsible for stolen devices. To the fullest extent permitted by Nigerian law, sellcondhand.ng, its officers, and staff will not be liable for, and disclaim all responsibility for, any loss, damage, cost, network blacklisting, confiscation by authorities, or other consequence arising from the sale or purchase of a device that is later found, reported, or alleged to be stolen, cloned, or otherwise unlawfully obtained. This includes situations where a device is seized by the Nigeria Police Force or another authority, blocked by a network operator, or reclaimed by a third-party owner after it has already been delivered to a Buyer. sellcondhand.ng is a facilitator of the transaction between Buyer and Seller and is not a party to, and does not guarantee, the underlying sale.
What we do if a device is reported stolen. Where we receive a credible report or police complaint that a listed or sold device is stolen, we may suspend the listing, freeze any escrow funds connected to that order pending investigation, suspend or permanently terminate the Seller's (and, where appropriate, the Buyer's) account, and disclose relevant account and transaction information to the Nigeria Police Force, the Economic and Financial Crimes Commission (EFCC), or another competent authority. Proceeds held in escrow or in a Seller's wallet that relate to a confirmed stolen device may be forfeited and are not guaranteed to be released to the Seller. Buyers who knowingly purchase a device they know or suspect to be stolen may themselves be committing an offence under Nigerian law and are not protected by this Platform.
9. Payments, Wallet and Escrow
All prices on the Platform are shown in Nigerian Naira (₦). Payment can be made from your sellcondhand.ng wallet or through a supported card or bank transfer gateway (currently Paystack and Flutterwave). When you pay for an order or a standalone Escrow deal, your payment is held in escrow by sellcondhand.ng — it is released to the Seller once you confirm the item arrived as described, or automatically 72 hours after delivery is marked if you haven't confirmed receipt or raised a dispute, whichever happens first. If you raise a dispute before then, the escrowed funds remain held pending resolution rather than being released to the Seller. Once a payout is released, it lands in the Seller's sellcondhand.ng wallet, from which it can be withdrawn.
Withdrawing funds from your wallet to a bank account requires your phone number to be verified (see Section 2) and a bank account you've added and confirmed through our payment partner's account-lookup service, so we can match the account name to you before paying out. Withdrawal requests (minimum ₦1,000) are reviewed and processed by sellcondhand.ng to the bank account on file, rather than paid out automatically and instantly.
10. Fees and Commission
There are no listing fees on sellcondhand.ng, for auctions or the Marketplace. Sellers pay a commission of 5% of the sale price (minimum ₦5,000, capped at ₦50,000 per device), deducted automatically from their payout. Buyers pay an escrow and logistics fee of 2.5% of the item price or winning bid (minimum ₦4,500, capped at ₦50,000), shown as its own line item before payment is made. These same rates apply to a standalone Escrow deal unless we state otherwise when the deal is created. Fees may be updated from time to time; the fee shown to you at checkout or at listing is the fee that applies to that transaction. Repairs by Sellcondhand has its own, separately priced fee structure — see Section 13.
11. Shipping and Delivery
Sellers are responsible for accurately describing the device's location and for shipping or handing over the device to the Buyer within the timeframe stated at checkout. Buyers are responsible for providing an accurate delivery address and for promptly inspecting the device on receipt. sellcondhand.ng does not itself operate courier or logistics services and is not liable for loss or damage to a device while it is in transit between Seller and Buyer, except to the extent escrow funds are withheld or refunded through our dispute process described below. This section covers Auction, Marketplace, and standalone Escrow deals involving a physical item shipped or handed over between Buyer and Seller — Repairs by Sellcondhand doesn't involve shipping a device to us or to an Engineer; see Section 13 for how a repair visit works.
12. Disputes and Refunds
If a delivered device does not match its listing, is materially damaged in transit, or does not arrive at all, the Buyer should open a dispute from their Order page before the 72-hour auto-confirmation window described in Section 9 elapses, rather than confirming receipt. Disputes are reviewed by sellcondhand.ng, and escrowed funds are released, partially released, or refunded to the Buyer based on the outcome of that review. Buyers and Sellers agree to respond promptly and honestly to any request for information made as part of a dispute. This section applies to Auction, Marketplace, and standalone Escrow deals — a dispute over a repair job is handled under Section 13.
13. Repairs by Sellcondhand
Repairs by Sellcondhand (repairs.sellcondhand.ng) is our doorstep device-repair service, connecting customers with independent, approved Engineers. It is currently available in Lagos only — we will extend coverage to other states as we build out our Engineer network there.
Booking and payment. When you book a repair, you select the problem(s), your address and area (zone), and a price is quoted from our catalog — or, for board-level/motherboard work, a fixed diagnosis fee is charged upfront and a real quote is given by the Engineer after inspecting the device on-site. You confirm the booking with a one-time code sent to your verified phone number. The quoted repair price, plus an escrow fee, a flat logistics/callout fee, the diagnosis fee (board-level work only), and an optional insurance fee (if you declare a device value), is collected upfront and held in escrow by sellcondhand.ng, the same way a Marketplace or Auction order is.
Repairs fees. Escrow fee: 3% of the quoted repair price (minimum ₦1,000, capped at ₦10,000). Logistics/callout fee: a flat ₦1,500 per request. Insurance fee (optional): 1.5% of the device value you declare, covering sellcondhand.ng's liability while your device is with an Engineer mid-repair. Diagnosis fee (board-level/motherboard work only): a flat ₦5,000 collected upfront in place of a fixed price — it covers the visit itself and isn't credited against the engineer's eventual quote. Engineers keep 85% of the final quoted repair price; sellcondhand.ng retains 15% as commission. These figures may be updated from time to time; whatever is shown to you at booking is what applies to that request.
Dispatch and completion. Once paid, your request is offered to approved, online Engineers covering your zone; the first to accept is assigned to your job. You'll see the Engineer's name, photo, and rating before they arrive. When the repair is complete, you confirm it on the spot, since you're present with the Engineer — this releases payment to the Engineer immediately, minus our commission. If something is wrong, raise a dispute instead of confirming.
Cancellation. You may cancel a request for free at any point before an Engineer is en route (i.e., while it's Pending Payment, Searching, or Assigned) — a paid request is refunded in full to your wallet. Once an Engineer is en route or the job is in progress, cancellation isn't self-serve; contact us or raise a dispute instead, since an Engineer has already committed real time and travel to the job.
Engineers are independent contractors. Engineers are independent technicians approved to accept jobs through the Platform after we verify their identity — they are not employees, agents, or subcontractors of sellcondhand.ng, and sellcondhand.ng does not itself perform any repair. We verify an Engineer's identity before approving their application, but this is not a certification of their technical skill, and to the fullest extent permitted by Nigerian law, sellcondhand.ng is not liable for the quality of a repair, for further damage caused during a repair, or for any act or omission of an Engineer while on a job, beyond what is covered by the insurance fee (if declared and paid) and our dispute-resolution process. If you're not satisfied with a completed repair, raise it with us — we take it seriously and factor it into an Engineer's ongoing approval to work through the Platform.
14. Prohibited Conduct
In addition to the prohibition on stolen or unlawfully obtained devices in Section 8, you agree not to:
- List or sell any illegal, counterfeit, or dangerous item, or any device that is not a genuine, working (or accurately disclosed) electronic device;
- Bid on your own listing, use multiple accounts to bid against yourself, or otherwise manipulate an auction's price;
- Provide false, inaccurate, or misleading registration, listing, KYC, Engineer application, or payment information;
- Attempt to complete a transaction, Escrow deal, or repair job outside the Platform to avoid escrow protection or applicable fees;
- Use automated tools, bots, or scripts to access, scrape, or bid on the Platform;
- Harass, threaten, or defraud another user, or interfere with another user's ability to use the Platform;
- Attempt to circumvent, disable, or interfere with the security or proper functioning of the Platform.
15. Account Suspension and Termination
We may suspend or terminate an account, without prior notice, where we reasonably believe it has been used to list or sell a stolen or unlawfully obtained device, to commit fraud, to manipulate an auction, to repeatedly miss payment or dispatch deadlines (see Section 7), or to otherwise breach these Terms. You may also close your own account at any time by contacting us; any pending orders or escrow obligations must be settled first. An Engineer's approval to accept repair jobs may similarly be suspended or revoked at our discretion for poor conduct, repeated disputes, or a breach of these Terms.
16. Intellectual Property
The sellcondhand.ng name, logo, and the design, text, and software of the Platform belong to us or our licensors and may not be copied, reproduced, or used for any commercial purpose without our written permission. Photos and descriptions you upload for a listing remain yours, but you grant us a license to display them on the Platform for the purpose of operating the marketplace.
17. Disclaimers and Limitation of Liability
The Platform is provided on an "as is" and "as available" basis. While we review listings, verify Engineer identity, and operate an escrow and dispute process to protect Buyers, Sellers, and repair customers, we do not guarantee that every listing is accurate, that the Platform will be uninterrupted or error-free, or that any device is free from defects not disclosed by the Seller. To the fullest extent permitted by Nigerian law, sellcondhand.ng will not be liable for indirect, incidental, or consequential losses arising from your use of the Platform, and our total liability for any claim relating to a transaction will not exceed the fees you paid to sellcondhand.ng for that transaction. Nothing in these Terms limits any liability that cannot be excluded under Nigerian law.
18. Indemnification
You agree to indemnify and hold sellcondhand.ng harmless from any claim, loss, or expense (including reasonable legal costs) arising from your breach of these Terms, your listing or sale of a device you were not entitled to sell, your performance of a repair job if you are an Engineer, or your violation of the rights of another user or third party.
19. Governing Law and Disputes
These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising from these Terms or your use of the Platform that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.
20. Changes to These Terms
We may update these Terms from time to time, for example as our features or applicable Nigerian regulations change. We will update the "Last updated" date above when we do. Continued use of the Platform after a change takes effect means you accept the updated Terms.
